释义	违法，扰乱公共秩序的行为，是指行为人扰乱公共秩序情节轻微，尚不够刑事处罚，依照《治安管理处罚法》和其他法律法规的规定，应当给予治安行政处罚的行为。法律依据：《中华人民共和国刑法》第二百九十条规定：聚众扰乱社会秩序，情节严重，致使工作、生产、营业和教学、科研无法进行，造成严重损失的，对首要分子，处三年以上七年以下有期徒刑；对其他积极参加的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。
