释义	没离婚跟别人生孩子算重婚吗尚未离婚就与他人生育子女，不能认定是重婚罪的。重婚罪，是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。所谓有配偶，是指男人有妻、女人有夫，而且这种夫妻关系未经法律程序解除尚在存续的，即为有配偶的人；如果夫妻关系已经解除，或者因配偶一方死亡夫妻关系自然消失，即不再是有配偶的人。所谓明知他人有配偶而与之结婚的，是指本人虽无配偶，但明知对方有配偶，而故意与之结婚的(包括登记结婚或者事实婚)。此种行为是有意破坏他人婚姻的行为。
