释义	法律分析：婚外情只能受到道德的谴责和约束，可以因为老公婚外情而提出离婚。小三一般不会被判刑；但如果女方明知男女已经结婚与其结婚或者以夫妻名义同居的，构成重婚罪，要被判处两年以下有期徒刑或者拘役。若破坏军婚，情节则更为严重，会被判处三年以下有期徒刑或者拘役。法律依据：《刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。《刑法》第二百五十九条明知是现役军人的配偶而与之同居或者结婚的，处三年以下有期徒刑或者拘役。
