释义	法律分析：如果双方当事人之间有约定留置的，债权人按照合同约定行使留置权，此时债权人占有债务人的财产就是合法的；相反，如果双方当事人之间没有约定留置或其他相关权利的，债权人没有按照合同规定，私自占用债务人财产，那么这种行为不合法，债务人可以提出起诉。法律依据：《民法典》第四百四十七条债务人不履行到期债务，债权人可以留置已经合法占有的债务人的动产，并有权就该动产优先受偿。前款规定的债权人为留置权人，占有的动产为留置财产。
