释义	法律规定使用童工是违法的，童工合同也没有法律效力的。法律依据：《中华人民共和国劳动法》第15条规定，禁止用人单位招用未满16周岁的未成年人。《中华人民共和国劳动法》第94条，用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款；情节严重的，由工商行政管理部门吊销营业执照。情节严重的，则依照《中华人民共和国刑法》定罪处罚。
