释义	法律分析: 其营销内容如果构成广告，而广告内容虚假误导消费者或者散步谣言就违法。如果营销号发布一般内容，则不构成违法。法律依据: 《中华人民共和国刑法》第二百四十六条以暴力或者其他方法公然侮辱他人或者捏造事实诽谤他人，情节严重的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。前款罪，告诉的才处理，但是严重危害社会秩序和国家利益的除外。《中华人民共和国广告法》第四条广告不得含有虚假或者引人误解的内容，不得欺骗、误导消费者。广告主应当对广告内容的真实性负责。
