公司清算后债权怎样处理呢?
释义
公司依法定程序进行注销,要成立清算组进行公告清理债权债务,如果经公告,在45天内,债权人没有申请债权视为自动放弃。如果没有公告,没有进行清算,由股东来承担法律责任。 可以查工商档案,档案中应该有该单位债权债务承受人,否则工商部门不会核准注销的。可以要求债权债务承受人承担责任。
法律依据:
《中华人民共和国民法典》 第五百五十一条 债务人将债务的全部或者部分转移给第三人的，应当经债权人同意。债务人或者第三人可以催告债权人在合理期限内予以同意，债权人未作表示的，视为不同意。
