问题	用人单位拖欠工资的法律规定
释义	依据《劳动法》的相关内容规定，工资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的工资。依据《违反和解除劳动合同的经济补偿办法》第三条，用人单位克扣或者无故拖欠劳动者工资的，以及拒不支付劳动者延长工作时间工资报酬的，除在规定的时间内全额支付劳动者工资报酬外，还需加发相当于工资报酬百分之二十五的经济补偿金。所以如果公司长期扣押工资不发给员工可以要求让公司立即支付拖欠的工资并支付相当于拖欠工资总额百分之二十五的经济补偿金。
