释义	人民法院审理附带民事诉讼案件，不收取诉讼费。刑事附带民事案件是在刑事案件诉讼过程中同时提起民事诉讼，根据法规的规定是不须交纳案件受理费的。但当事人在刑事案件诉讼过程中不提起刑事附带民事诉讼，而就民事部分另行提起民事诉讼，应按照民事案件收费标准交纳诉讼费。《最高人民法院关于适用《中华人民共和国刑事诉讼法》的解释》第一百六十二条人民法院审理附带民事诉讼案件，不收取诉讼费。
