法律分析:
第一种情况，如果与房东之间没有约定水管的维修是由承担，而且也没有过错，确因水管老化致使楼下损失，那么就不需要承担赔偿责任，由房东来承担赔偿责任。出租人应当按照约定将租赁物交付承租人，并在租赁期间保持租赁物符合约定的用途。出租人应当履行租赁物的维修义务，但当事人另有约定的除外。第二种情况，有过错就要承担赔偿责任。所谓过错，就本案是指知道或者应当知道水管已经老化有破裂的危险，却没有采取措施防止损害发生的状态。承租人应当妥善保管租赁物，因保管不善造成租赁物毁损、丢失的，应当承担损害赔偿责任。公民、法人由于过错侵害国家、集体财产，侵害他人财产、人身的，应当承担民事责任。第三种情况，与房东之间明确约定了水管的维修由承担，是需要承担赔偿责任的。依法成立的合同，对当事人具有法律约束力。当事人应当按照约定履行自己的义务，不得擅自变更或者解除合同。依法成立的合同，受法律保护。
