释义	申诉人在人民法院判决、裁定生效二年之内无正当理由，未向人民检察院提出申诉的案件，应不予受理。《民事诉讼法》规章，人民检察院对人民法院已经发生法律效力的判决、裁定，发现确有错误的，可以通过抗诉方法进行监督。但法律并没有规章当事人向人民检察院申诉抗诉的时限。但是检察院自己抗诉就没有期限。法律依据：《关于当前审判监督工作若干问题的纪要》规章：原审案件当事人在原审裁判生效二年内无正当理由，未向人民法院或人民检察院提出申诉的案件，人民检察院提出抗诉的，人民法院不予受理。
