释义	赠与的房子未过户不能卖。赠与房屋未过户的，房屋产权仍然属于赠与人所有。即使受赠人实际使用房屋，但是只要没有办理房屋产权变更登记，那么房屋产权实际仍属于赠与人。没有过户的赠与房屋，不可以擅自进行买卖。受赠人擅自买卖的，涉嫌无权处分他人财产，且当赠与人撤销赠与或不配合办理过户登记时，受赠人要对第三人承担违约责任。【本文关联的相关法律依据】《中华人民共和国民法典》第六百五十九条赠与的财产依法需要办理登记或者其他手续的，应当办理有关手续。
