释义	法律分析：找不到失主不上交的是违法行为，捡到贵重东西拒不上交的，构成非法侵占。法律依据：《中华人民共和国刑法》第二百七十条拾遗拒不交出者，应处以徒刑、拘役和罚金。为防止拾得他人钱物而拒不归还，我国刑法设立了“侵占罪”，凡以非法占有为目的，将代为保管的他人财物或他人的遗忘物占为己有，数额较大、拒不退还或拒不交出的行为，就构成侵占罪，要受到刑事处罚。犯侵占罪，一般处二年以下有期徒刑、拘役或者罚金，数额巨大或者其他严重情节的要处二年以上五年以下有期徒刑。
