释义	一、申请工伤鉴定有时间限制工伤认定一般在工伤发生后30日内由用人单位提出，如果用人单位不提出，工伤职工或者直系亲属可以在工伤发生1年内提出，受理的部门是劳动局（内专设工伤认定的部门）。二、鉴定机构省、地（市）二级劳动鉴定委员会按照评残标准鉴定伤残等级和护理等级。劳动鉴定委员会受当地政府委托，由劳动、卫生、工会等部门的有关主管领导组成，下设办公室负责日常工作。可以委托有资格的医院，也可以聘请有关专家组成专家组或者设立劳动鉴定中心，开展劳动鉴定工作，但应当客观公正地作出鉴定结论。
