二手房交易有哪些注意事项 |

二手房交易时，应着重注意以下事项：1、必须核实卖方的不动产权证书及房屋产权证。2、要求中介对房屋进行查档并将查档结果提供给买方。3、注意房屋的建设时间，土地使用权剩余年限。4、对比同地段类似房屋的价格。5、过户前不宜支付房屋全款和全部中介费。如果房屋产权证登记的是卖方夫妻共同共有，则在签署房屋买卖合同时，必须要卖方夫妇同时当面签署，仅一方签署的合同效力没有保障。在不动产登记机构进行的房产查档可以显示房屋是否存在抵押、查封等情况，可以判断该房屋是否可以合法交易。房屋的楼龄对房价和是否可以贷款，可以贷款多少年有直接影响。过户前如果支付全款，如果因为意外因素无法过户，买方权利很难保障。中介费也最好在过户及交付房屋后支付尾款，否则发生无法过户或收楼时，中介很可能推脱责任。法律依据《中华人民共和国城市房地产管理法》第三十四条 国家实行房地产价格评估制度。房地产价格评估，应当遵循公正、公平、公开的原则，按照国家规定的技术标准和评估程序，以基准地价、标定地价和各类房屋的重置价格为基础，参照当地的市场价格进行评估。《中华人民共和国城市房地产管理法》第四十一条 房地产转让，应当签订书面转让合同，合同中应当载明土地使用权取得的方式。《中华人民共和国城市房地产管理法》第四十二条 房地产转让时，土地使用权出让合同载明的权利、义务随之转移。
