释义	虐待应该承担的民事责任家庭成员间的虐待，是指用打骂、冻饿、有病不给治疗等方法摧残、折磨家庭成员，使他们在肉体上、精神上遭受痛苦的行为。虐待家庭成员，破坏了家庭的和睦生活，违背了社会主义道德准则，亦为法律所不容。虐待家庭成员，情节恶劣的，即构成虐待罪，要受刑法所制裁。虐待家庭成员的，虐待人应当承担停止虐待、赔礼道歉的民事责任。造成受虐待人身体伤害的，虐待人还应当赔偿医疗费。伤残赔偿金等费用。
