释义	法律分析：未签订劳动合同的二倍工资应当自用工之日起第二个月开始支付直至签订劳动合同前一日，或劳动关系终止前一日。但用工之日起超过一年仍未签订劳动合同的，二倍工资应当计算至满一年前，也就是说未签订劳动合同的二倍工资最长只能计算十一个月。由于超过一年后，双方就视为已经签订无固按期限劳动合同劳动合同，对于2008年1月1日前已经用工未签订劳动合同的，应当在2月1日前签订劳动合同，没有签订的应当自2月1日起支付二倍工资，2008年1月1日之前没有签订劳动合同是不能就算二倍工资的。
