问题	劳动争议期间工资是否应予以支持
释义	劳动者和公司发生劳动争议期间，如果劳动者和公司的劳动关系仍然存续，即劳动者继续在公司工作，公司就应该根据劳动合同的规定给劳动者支付相应的工资。法律依据《最高人民法院关于审理劳动争议案件适用法律若干问题的解释（二）》第二条拖欠工资争议，劳动者申请仲裁时劳动关系仍然存续，用人单位以劳动者申请仲裁超过六十日为由主张不再支付的，人民法院不予支持。但用人单位能够证明劳动者已经收到拒付工资的书面通知的除外。
