如老人父母已去世，老人本人未婚且无子女，即老人无第一顺序法定继承人。
在上述情况下，老人的兄弟姐妹又先于老人死亡的，其兄弟姐妹的子女就可以通过代位继承，继承老人的遗产。
只能是被继承人的兄弟姐妹的子女，被继承人的兄弟姐妹的配偶及孙子女是无法代位继承的。
