问题	刑事复议复核的规定
释义	第一条为了规范公安机关刑事复议、复核案件的办理程序，依法保护公民、法人和其他组织的合法权益，保障和监督公安机关依法行使职责，根据《中华人民共和国刑事诉讼法》及相关规定，制定本规定。第二条刑事案件中的相关人员对公安机关作出的驳回申请回避、没收保证金、对保证人罚款、不予立案决定不服，向公安机关提出刑事复议、复核申请，公安机关受理刑事复议、复核申请，作出刑事复议、复核决定，适用本规定。第三条公安机关办理刑事复议、复核案件，应当遵循合法公正、有错必纠的原则，确保国家法律正确实施。
