释义	法律分析: 如果用人单位一方或者劳动者一方具有欺诈的故意，并且使用了欺诈的手段骗取对方签订空白的劳动合同，则算欺诈。因欺诈而订立的劳动合同部分或者全部无效。如果当事人一方不具有欺诈的故意，也未采用欺诈的手段的，则不算欺诈。法律依据:《《中华人民共和国劳动合同法》》第二十八条【劳动合同无效后劳动报酬的支付】劳动合同被确认无效，劳动者已付出劳动的，用人单位应当向劳动者支付劳动报酬。劳动报酬的数额，参照本单位相同或者相近岗位劳动者的劳动报酬确定。
