释义	路人指使交通肇事逃逸构成共犯吗交通肇事非乘车人指使逃逸一般不构成共犯。《最高人民法院关于审理交通肇事刑事案件具体应用法律若干问题的解释》第五条第二款规定“交通肇事后，单位主管人员、机动车辆所有人、承包人或者乘车人指使肇事人逃逸，致使被害人因得不到救助而死亡的，以交通肇事罪的共犯论处”。非乘车人如果属于单位主管人员、机动车辆所有人、承包人之一，指使肇事人逃逸，致使被害人因得不到救助而死亡的，构成交通肇事罪共犯。
