和分公司发生纠纷，能告总公司吗

法律分析：要依情况而定。如果该分支机构是依法设立的，而且领取了营业执照，那么它可以单独作为当事人，也可以与它的具有法人资格的总公司共同作为诉讼当事人；如果该分支机构没有依法设立，或是未领取营业执照，那么应当以其总公司为诉讼当事人。
法律依据：《中华人民共和国公司法》 第十四条 公司可以设立分公司。设立分公司，应当向公司登记机关申请登记，领取营业执照。分公司不具有法人资格，其民事责任由公司承担。公司可以设立子公司，子公司具有法人资格，依法独立承担民事责任。
