释义	借钱不还和诈骗罪是有一定得距离的，但借钱不还还是可能构成诈骗罪的，只要借钱不还达到借贷式诈骗要件的，就会构成诈骗罪。诈骗罪，是指“以非法占有为目的，采用虚构事实或隐瞒真相的欺骗方法，使受害人陷于错误认识并“自愿”处分财产，从而骗取数额较大以上公私财物的行为”。借贷式诈骗与民事债权债务纠纷在表现形式上有很多相似之处，如都是以借款为名转移财产、到期无法偿还债务等等。
