释义	口头遗嘱须有两个以上证人在场见证，须为紧急情况不能以其他方式设立遗嘱，紧急情况解除，遗嘱人能够用书面或录音形式立遗嘱的，所立口头遗嘱无效。口头遗嘱的条件须为立遗嘱人当时已经来不及用其他方式，如果有时间能够用书面或录音形式立遗嘱，那么则口头遗嘱的意思表示不具有法律规定的遗嘱效力，所立口头遗嘱无效，应按法定继承分配遗产。法律依据《民法典》第一千一百三十八条
