问题	因重大误解订立的合同要怎样处理
释义	《合同法》规定了当事人一方有权请求人民法院或者仲裁机构变更或者撤销合同的情形，其中第一项就是重大误解，当事人请求变更的，人民法院或者仲裁机构不得撤销也就是说，因重大误解订立的合同当事人有权选择是否申请变更或撤销，在没有申请变更或撤销前合同是有效的。根据《合同法》第54条规定，下列合同，当事人一方有权请求人民法院或者仲裁机构变更或者撤销：(一)因重大误解订立的。(二)在订立合同时显失公平的。
