不合法，劳动者付出的劳动，用人单位应该依法支付工资。
【法律依据】:
《工资支付暂行规定》第八条 对完成一次性临时劳动或某项具体工作的劳动者，用人单位应按有关协议或合同规定在其完成劳动任务后即支付工资。
第九条 劳动关系双方依法解除或终止劳动合同时，用人单位应在解除或终止劳动合同时一次付清劳动者工资。
