释义	法律分析：视情况而定。没有逮捕不代表不需要负刑事责任。如果案件事实清楚、证据充分的话，公安还是会把案件移送检察院审查起诉，检察院如果审查认为构成犯罪的话还是会向法院提起公诉，法院最后判刑；若果经查证后确无犯罪事实，则不会判刑。法律依据：《中华人民共和国刑事诉讼法》第八十七条公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连同案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
