发现超期羁押如何处理
依据我国相关法律的规定，人民检察院发现同级或者公安机关、人民法院超期羁押的，应当向该办案机关发出纠正违法通知书。
《人民检察院刑事诉讼规则》
第六百一十八条人民检察院发现同级或者下级公安机关、人民法院超期羁押的，应当向该办案机关发出纠正违法通知书。
发现上级公安机关、人民法院超期羁押的，应当及时层报该办案机关的同级人民检察院，由同级人民检察院向该办案机关发出纠正违法通知书。
对异地羁押的案件，发现办案机关超期羁押的，应当通报该办案机关的同级人民检察院，由其依法向办案机关发出纠正违法通知书。
羁押期限
羁押是司法机关对犯罪嫌疑人在终审判决前的暂时关押。
羁押不是刑事诉讼法规定的强制措施，而是刑事拘留和逮捕的附带性后果。
羁押期限，是指拘留和逮捕的法定期限。羁押期限包括：侦查阶段、审查起诉阶段和审判阶段三阶段的期限。
在侦查阶段，羁押分拘留和逮捕两种形式，其中拘留又分为公安机关侦查案件和检察机关自侦案件两种情况。
公安机关侦查案件：羁押期限为十四日。这十四日包括：对被拘留的人，认为需要逮捕的，应当在拘留后的三日以内，提请人民检察院审查批捕。在特殊情况下，提请审查批准的时间可以延长一至四日。人民检察院审查批准逮捕的期限为七日。但对于流窜作案、多次作案、结伙作案的重大嫌疑分子，法律规定提请审查批准的时间可以延长至三十日。
检察机关自侦案件：羁押期限为十七日。对被拘留的人，认为需要逮捕的，应当在十四日以内作出决定。在特殊情况下，决定逮捕的时间可以延长一日至三日。
