释义	原告不出庭法院会按照撤诉处理。原告经传票传唤，无正当理由拒不到庭的，或者未经法庭许可中途退庭的，可以按撤诉处理。如果是被告反诉，然后又不到庭，经过法院传票传唤仍然不到庭，则可以缺席判决。但是原告就不一样了，他要是死活不出庭，那就按撤诉处理了。法律依据：《中华人民共和国民事诉讼法》第一百四十三条规定，原告经传票传唤，无正当理由拒不到庭的，或者未经法庭许可中途退庭的，可以按撤诉处理;被告反诉的，可以缺席判决。
