释义	法律分析：违章建筑的形成有很多原因，但违章建筑因为缺乏某些程序要件或者实质要件是需要被拆除的。违章建筑可以强拆，但是即使强制拆除违法建筑，拆除之前应当先通知相对人自行拆除，在当地张贴公告且不得在夜间拆除。法律依据：《中华人民共和国城乡规划法》第六十八条城乡规划主管部门作出责令停止建设或者限期拆除的决定后，当事人不停止建设或者逾期不拆除的，建设工程所在地县级以上人民政府可以责成相关部门采取查封施工现场、强制拆除等措施。
