民法典规章农村土地所有权如何继承
释义
虽然土地所有权不属于农民，但是土地的承包权以及经营权却是属于的农民尤其是现阶段农村土地实行家庭承包制，承包人是指承包土地的农户家庭。
法律依据：
《中华人民共和国农村土地承包法》 第三十一条 承包人应得得承包收益，依照继承法的规章继承，承包耕地、草地的家庭中某一人死亡，其他成员还在，不发生继承问题，仍由其他成员继续承包。也就是说子女父母同属一个家庭，父母去世后，土地则尤其子女继续承包。
