缓刑考验期内可以签订劳动合同。劳动权是公民的法定权利，判处刑罚并不剥夺劳动者劳动的劳动权利。用人单位可以与劳动者签订劳动合同，如果当事人需要续签劳动合同，被判处刑罚的人只要在缓刑考验期内不再犯罪，其判决刑期暂不执行，只要用人单位与劳动者协商一致同意继续履行劳动合同或者续签劳动合同，劳动合同可以得到继续履行。
法律依据：
《中华人民共和国劳动合同法》 第九条 用人单位招用劳动者，不得扣押劳动者的居民身份证和其他证件，不得要求劳动者提供担保或者以其他名义向劳动者收取财物。
