释义	法律分析：银行担保是在发生共同海损或救助行为时，由银行出面替货方或被救方向船方或救助方提供担保称为 “银行担保”。由于银行在出具这一担保后，需要承担日后共同海损分摊额和救助报酬的支付保证，因此，银行在出具这种担保时，要慎重考虑申请担保人的信誉，同时还要收取一定的担保手续费。法律依据：《中华人民共和国民法典》第六百八十三条，机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。
