释义	对方自愿还构成强奸罪吗一般情况下，女方完全自愿不构成强奸。但是有两种例外情况，无论女方是否自愿均构成强奸罪。例外情况，根据《刑法》第236条第二款“奸淫不满十四周岁的幼女的，以强奸论”。因此与未满十四周岁的幼女发生性行为的，行为人是否采用了暴力、胁迫等手段，也不论对方是否表示同意，均应以强奸论。
