法律依据：
《中华人民共和国劳动合同法》 第四十条 劳动者不能胜任工作，用人单位可以调整一个工作岗位。人力资源和社会保障局明确表示，如果在哺乳期，原来某些职位目前可能不能胜任。在此情况下，经过协商，用人单位可以调换劳动者工作岗位，但必须有足够证据证明劳动者不能胜任原岗位，而且必须与劳动者协商。如果用人单位没有足够证据证明劳动者不能胜任原工作，而单方面调换职位，劳动者可申请劳动争议仲裁维护自己的合法权益。
