释义	抗诉书不是给同级法院，是给上一级法院的。人民检察院在认为本级人民法院第一审的判决、裁定确有错误的时候，应当向上一级人民法院提出抗诉。人民检察院提起抗诉，应当采用书面形式。【法律依据】《刑事诉讼法》第二百二十八条地方各级人民检察院认为本级人民法院第一审的判决、裁定确有错误的时候，应当向上一级人民法院提出抗诉。第二百三十条不服判决的上诉和抗诉的期限为十日，不服裁定的上诉和抗诉的期限为五日，从接到判决书、裁定书的第二日起算。
