释义	劳动保障部办公厅劳社厅函《关于劳动争议案中涉及商业秘密侵权问题的函》第二项规定：“劳动合同中明确约定了有关保守商业秘密的内容，由于劳动者未履行，造成用人单位商业秘密被侵害而发生劳动争议，当事人向劳动争议仲裁委员会申请仲裁的，仲裁委应当受理，并依据有关规定和合同的约定作出裁决。”因此，劳动争议仲裁委员会有权对职工与用人单位间发生的商业秘密侵权案进行仲裁。
