释义	构成放纵走私罪法院的量刑是处五年以下有期徒刑或者拘役；情节特别严重的，处五年以上有期徒刑。放纵走私罪是指海关工作人员徇私舞弊，违反法律规定，明知是走私行为而予以放纵，使之不受查究，情节严重的行为。【法律依据】《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第四百一十一条海关工作人员徇私舞弊，放纵走私，情节严重的，处五年以下有期徒刑或者拘役；情节特别严重的，处五年以上有期徒刑。
