释义	法律分析: 法定节假日加班的，不能调休，只能结算加班费，无论哪种工时制度。实行标准工时制度的，周末加班，可以用等时的工作日调休。（调休不成的，按最低2倍工资计发加班费）。工作日加点，指的是8小时下班之后又留下来工作的，这个也不能调休，只能计算加班费（按最低1.5倍标准计发）。法律依据: 《中华人民共和国劳动合同法》第三十一条用人单位应当执行劳动定额标准，不得强迫或变相强迫劳动者加班。用人单位安排加班的应按照国家有关规定向劳动者支付加班费。
