释义	单纯的出轨行为是不违反法律的规定的，行为人只会受到道德上的谴责。但若是构成重婚罪的，应当承担相应的刑事责任。重婚是指有配偶和其他人登记结婚的，或者明知他人有配偶而与之结婚的。法律依据: 《刑法》第二百五十七条以暴力干涉他人婚姻自由的，处二年以下有期徒刑或者拘役。犯前款罪，致使被害人死亡的，处二年以上七年以下有期徒刑。第一款罪，告诉的才处理。第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
