国有土地使用证的出让和转让有哪些区别 |

法律分析：
二者的区别如下：
1、使用范围不同：划拨土地属政策性用地，一般只能用于公益事业和基础设施建设工程等，不用于其他商业目的，目前的经济适用住房建设用地也均以划拨方式取得。
2、补偿标准不同：如果遇到政府拆迁，出让土地的补偿费要比划拨土地的补偿费标准高出许多。
3、使用期限不同：划拨土地使用权没有使用期限的限制，因此，除非政府因规划变更需收回土地使用权或土地使用者要转让土地及地上建筑物，使用者可以无限期使用。
4、转让条件不同：划拨土地的转让须经原批准使用土地的机关批准，经济适用房转让还须经过一定的年限，且转让时须补偿土地使用权出让金，而出让土地和商品房的转让则没有这样的限制。
法律依据：
《城镇国有土地使用权出让和转让暂行条例》第十条 土地使用权出让的地块、用途、年限和其他条件，由市、县人民政府土地管理部门会同城市规划和建设管理部门、房产管理部门共同拟定方案，按照国务院规定的批准权限报经批准后，由土地管理部门实施。
第十一条 土地使用权出让合同应当按照平等、自愿、有偿的原则，由市、县人民政府土地管理部门（以下简称出让方）与土地使用者签订。
