问题	劳动合同无效能获双倍工资吗
释义	如果说被认定为劳动合同无效这种情况的话，对方工作所得的报酬应当全部支付给对方，但是一般不会有双倍工资。在无效合同的情形下，劳动者付出劳动的，用人单位应当支付劳动者劳动报酬。但只有在不签订书面劳动合同这种事实劳动关系的情形下，才适用双倍工资差额的罚则。法律依据：《劳动合同法》第82条规定：用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。
