释义	不算。劳动法仅禁止单位招用16周岁以下的未成年人，在法律上被称之为童工。年满16周岁就可以参加工作，年满16周岁不满18周岁的人以自己的工作作为生活来源的，可以视为成年人。法律依据：《中华人民共和国劳动法》第九十四条用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款；情节严重的，由工商行政管理部门吊销营业执照。
