释义	法律分析：新刑法对擅自设立金融机构罪的量刑标准为处三年以下有期徒刑或者拘役，并处或者单处罚金，或者三年以上十年以下有期徒刑，并处罚金。单位犯罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依规定处罚。法律依据《中华人民共和国刑法》第一百七十四条未经中国人民银行批准，擅自设立商业银行或者其他金融机构的，处三年以下有期徒刑或者拘役，并处或者单处二万元以上二十万元以下罚金；情节严重的，处三年以上十年以下有期徒刑，并处五万元以上五十万元以下罚金。
