释义	解除劳动合同计算补偿时应当首先考虑解除合同的方式与原因。如果员工在劳动合同未到期内主动辞职，则单位不需要支付经济补偿；如果单位与员工协商一致解除或劳动合同到期终止，则需要按照员工在单位的工作年限，每满一年支付一个月工资的标准向劳动者支付，6个月以上不满1年的，按1年计算不满6个月的，按半个月工资标准支付。如果单位单方面违法解除劳动合同的，则应当按照经济补偿金的双倍支付经济赔偿金。经济补偿金的月工资为劳动合同解除前职工12个月的本人月平均工资，工资计算标准最低不得低于当地最低工资标准。
