释义	法律分析：企业法人的职能部门能作保证人。但由于分支机构不是独立的法人主体，故不能独立承担责任，分支机构的责任最终仍由法人来承担。民法典实施后删除了企业法人的分支机构、职能部门不得作为保证人的规定。法律依据：《中华人民共和国民法典》第六百八十三条机关法人不得为保证人，但是经国务院批准为使用外国政府或者国际经济组织贷款进行转贷的除外。以公益为目的的非营利法人、非法人组织不得为保证人。
