释义	夫妻个人债务的举证责任： 1、夫妻单方举债的，原则上由举债人举证。也就是说，债务人认为是共同债务，而另一方认为是债务人的个人债务，债务人应当承担举证责任。债务人不能证明是共同债务的，视为债务人的个人债务； 2、夫妻共同借款的，原则上应当认定为共同债务。若有相反主张者，则提出相反主张者举证。【本文关联的相关法律依据】《中华人民共和国民法典》第一千零八十九条离婚时，夫妻共同债务应当共同偿还。共同财产不足清偿或者财产归各自所有的，由双方协议清偿；协议不成的，由人民法院判决。
