释义	根据《刑法》第262条的规定，拐骗不满14周岁的未成年人，脱离家庭或者监护人的，应当立案。本罪是行为犯，只要行为人实施了拐骗行为，将不满14周岁的未成年人带走，从而使该未成年人脱离家庭或者监护人的，原则上就不构成本罪，应当立案追究。法律依据《中华人民共和国刑法》第二百六十二条
