释义	法律分析: 不能正确表达意志的人，不能作为证人。待证事实与其年龄、智力状况或者精神健康状况相适应的无民事行为能力人和限制民事行为能力人，可以作为证人。因此，即使是小学生，只要其确实知道案件事实并且其年龄、智力和精神状况能够与待证事实相适应，也是可以作为证人出庭作证的。法律依据: 《中华人民共和国民事诉讼法》第七十二条凡是知道案件情况的单位和个人，都有义务出庭作证。有关单位的负责人应当支持证人作证。不能正确表达意思的人，不能作证。
